ABC Innovate shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use of or inability to use the Services.

You agree to indemnify and hold harmless ABC Innovate, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or your violation of these Terms.

7. Termination

ABC Innovate may terminate or suspend your access to the Services at any time, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.  

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya.

9. Entire Agreement

These Terms constitute the entire agreement between you and ABC Innovate regarding the use of the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
